Electronic Communications Consent (E-SIGN)

This Electronic Communications Consent (“E-Consent”) explains how loan-payday.com (“loan-payday.com,” “we,” “us,” or “our”) provides records and communications to you electronically. By using our Service or submitting our form, you consent to receive disclosures, notices, and other communications electronically under the federal Electronic Signatures in Global and National Commerce Act (the “E-SIGN Act”) and applicable state law. Please read this E-Consent carefully and keep a copy for your records.
1. Your consent
By submitting your information through our form or otherwise using the Service, you affirmatively consent and agree that:
- We may provide you with any and all communications, agreements, disclosures, notices, and other records (“Communications”) in electronic form;
- Electronic Communications have the same legal effect as if they were provided to you in paper form;
- Your electronic signature (including clicking “I agree,” submitting a form, or otherwise indicating assent) on any agreement, consent, or disclosure is legally binding and enforceable, and is the legal equivalent of your handwritten signature.
2. Scope of your consent
Your consent applies to all Communications we provide to you in connection with the Service, which may include:
- This E-Consent and our Privacy Policy, Terms of Use, and APR Disclosure;
- Consents and disclosures relating to your loan request and our matching service;
- Confirmations, service messages, and responses to your inquiries;
- Privacy notices and notices of changes to our policies or terms;
- Any other notice, record, or communication that we are required by law to provide or that we choose to provide to you in connection with the Service.
Note that lenders and other third parties with whom you interact will have their own electronic-communications consents and disclosures, separate from this one. This E-Consent covers Communications from loan-payday.com only.
3. How we deliver electronic Communications
We may deliver Communications to you by: (a) sending an email to the address you provide; (b) posting the Communication on our website; or (c) any other electronic means we reasonably choose. It is your responsibility to review Communications we send or post in a timely manner.
4. Hardware and software requirements
To access, view, and retain electronic Communications, you will need:
- A computer, smartphone, tablet, or other device with internet access;
- A current version of a web browser that supports 128-bit (or higher) SSL/TLS encryption (such as a recent version of Chrome, Safari, Firefox, or Edge);
- A valid email account and the software needed to send and receive email;
- Software that can view, save, and print PDF files (such as a current PDF reader);
- Sufficient storage space to save Communications, or a printer to print them;
- An active and current email address that you provide and keep up to date with us.
If our hardware or software requirements change in a way that creates a material risk that you may not be able to access or retain a Communication, we will notify you of the revised requirements and give you the opportunity to withdraw your consent.
5. Keeping copies of Communications
We recommend that you print or download and retain copies of all electronic Communications for your records. Communications posted on our website may not remain available indefinitely.
6. Requesting paper copies
You may request a paper copy of any Communication we have provided electronically. To do so, contact us using the details in Section 9 and identify the Communication you would like. We will provide a paper copy at no charge, unless otherwise stated. Requesting a paper copy will not, by itself, count as withdrawing your consent to receive Communications electronically.
7. Withdrawing your consent
You have the right to withdraw your consent to receive Communications electronically at any time. To withdraw consent, contact us using the details in Section 9 and state that you wish to withdraw your E-SIGN consent. Withdrawal of consent is effective only after we have had a reasonable period of time to process your request.
8. Keeping your contact information current
You are responsible for providing us with a true, accurate, and complete email address and for keeping that information up to date. You must promptly notify us of any change to your email address or other contact information so that we can continue to send you electronic Communications. You can update your information by contacting us using the details below. We are not responsible for Communications not received because your contact information was inaccurate or out of date.
